Terms and Conditions

Here's all the legal stuff... Mostly we're just trying to run a reasonable business with the kind of service you'd expect from people who care about their customers, but we're required to formalise the T's & C's, so here they are. Mostly it's all rather standard, but please pay special attention to our policy on refunds for payments not made via EFT (under "Order Process and Stock Availability" and "Returns, Refunds and Warranty") where the order was not first confirmed by us, due to the fees charged to us by some of the payment processing agents.

Detailed Description of Goods / Services

Dizzy Enterprises (Dane du Plooy t/a) is a business, in the electronics industry, which primarily markets microcontroller-related electronic development tools.

Order Process and Stock Availability

After receipt of an order placed through our online store, we will check the order and verify stock availability, before requesting payment via email.

An automated option to make payment immediately may also be made available by our website, in case it is inconvenient for you to wait for us to respond to your order via email first. Please note however that for some payment methods (such as credit card), fees may be incurred in the event that it should become necessary to process a refund (such as due to stock unavailability, where availability was not first confirmed by us). Refund costs in this scenario are indicated below:
  • EFT (Electronic Fund Transfer) - No cost, full refund possible to any South African bank account.
  • PayPal - No cost, full refund possible (although your bank may charge you some currency conversion fees, since payment to PayPal is usually in a non-local currency such as USD).
  • Bank Deposit - 1.5% of the order total, for refunds paid into a South African bank account.
  • Credit Card - 3.95% of the order total, plus R50 if it is necessary to process the refund back to the card rather than by EFT into a South African bank account. Refunds to cards may also not be possible in some cases, in which case refund via EFT into a South African bank account may be the only available option. If the customer does not have a South African bank account (such as in the case of an international customer), and refund to card is not possible, then refund will be processed by some other reasonable means (such as PayPal or wire-transfer into the customers bank account in their country).
In short, we prefer payment via EFT if possible, please :-).
We hope to be able to eliminate this clause in future, and in the unlikely event that a refund should be necessary, simply absorb any costs ourselves.

Should it become necessary to refund part or all of an order where we have first checked the order, confirmed stock availability and requested payment, then a full refund will be issued, regardless of the payment method used.

Delivery Policy

Subject to availability and receipt of payment, requests will be processed within 3 working days (that's the stated time, but it's normally within 1 working day) and dispatched via the selected delivery service or readied for collection. If processing time may be longer than usual, such as during holiday periods, then this will normally be indicated via a notice displayed at the top of our website. Updates to order status, such as delivery tracking number information, will be provided (via email, phone, or otherwise).

Returns, Refunds and Warranty

Return of correctly supplied goods will be accomodated where possible. Returns may however be declined in the event that the goods were specially supplied and are not part of our normal stock inventory. It is obviously not possible to return software with digital licensing options, such as a KeyFile license. If payment processing costs were incurred - as indicated above under "Order Process and Stock Availability" - then it may be necessary to deduct these costs from the refundable amount. Shipping costs are normally not refundable. Goods incorrectly supplied (or faulty goods) may be collected by us at our expense (from the point of delivery, or another location if agreed to by both the customer and us); and will be replaced with the correct goods (or repaired), or refunded in full (regardless of any payment processing costs incurred). All goods supplied carry a 1-year warranty for manufacturer defects.

Limitation of Liability

It is the customers responsibility to inspect goods upon receipt, confirm that they meet the customers expectations and are fit for the customers requirements / intended use (before implementing them as such), and take responsibility for them thereafter. Incorrectly supplied or faulty goods will be handled according to our returns, refunds and warranty policy (detailed above). What this means is that; if for example you use something purchased from us to build a coffee machine for a new base on Mars, and for example the part purchased from us fails and your coffee machine on Mars stops working, then we won't be responsible for e.g. the cost of retrieving the coffee machine from Mars in order to repair it. If you require us to accept further responsibility than that stated in this paragraph, then please talk to us and we'll see what we can work out (obviously additional costs will probably be involved).

Customer Privacy Policy

Dizzy Enterprises shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from http://www.polity.org.za/attachment.php?aa_id=3569.

Payment Options Accepted

Payment may be made via EFT (Electronic Fund Transfer), MasterCard / Visa credit cards, cash, bank deposit or PayPal. Dizzy Enterprises banking details are available from this link.

Credit Card Acquiring and Security (PayGate)

Where PayGate is specified as the payment option, credit card transactions will be acquired for Dizzy Enterprises via PayGate (Pty) Ltd who are the approved payment gateway in this case. PayGate is a licensed System Operator with the Payments Association of South Africa (PASA). PayGate is fully PCI compliant and uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer Details Separate from Card Details (PayGate)

Card details which are entered by the client on PayGate's secure site are neither accessible to nor stored by Dizzy Enterprises. Some customer details which are necessary for processing orders (but not including card details) may be stored by Dizzy Enterprises as part of normal business operation and accounting records.

Merchant Outlet Country and Transaction Currency (PayGate)

The merchant outlet country at the time of presenting payment options to the cardholder via PayGate is South Africa, and transaction currency in this case is South African Rand (ZAR).

Responsibility

Dizzy Enterprises takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, reasonable customer service and after-sales support, dispute resolution and dispatch of goods. Insurance for dispatched goods is available on request.

Country of Domicile

This website is governed by the laws of South Africa and Dizzy Enterprises chooses South Africa as its ‘domicilium citandi et executandi’ for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Variation

Dizzy Enterprises may, at its sole discretion, change this agreement or any part thereof at any time without notice.
